Exclusivity with an estate agent for the sale of your home means that you work with a single agency for a set period. Many sellers sign that document without reading the term or the cancellation conditions. That is a shame, because those very clauses determine how much room for manoeuvre you have over the coming months. What exclusivity actually means
An exclusive brokerage mandate gives an estate agency the sole right to offer your home for sale. For as long as that mandate runs, you may not bring in a second agent. Most contracts also state that you owe a fee if you find a buyer yourself during that period. Some agencies provide an exception for candidates you already knew before signing, but that then has to be set out in black and white in the agreement.
Against that stands the open mandate, also called the non-exclusive mandate. With it you work with several agencies at the same time and you only pay the agency that actually closes the sale. You keep your hands free, but you also give no single agency the certainty it needs to invest heavily in your file.
Note: the form of the mandate is separate from the fee percentage. An exclusive contract is not automatically cheaper, and an open mandate is not automatically more expensive. Ask about both matters separately when you compare estate agents, so that you compare like with like instead of a package price without its components.
What the Belgian rules allow
The legislator protects the consumer fairly firmly here. The royal decree of 12 January 2007 on the brokerage agreements of estate agents lays down that the first exclusive period may not run longer than six months. An agency that puts an exclusivity of one year in front of you is therefore outside the legal framework for private sellers.

The notice period and the way in which you cancel, by registered letter or by e-mail, have to be in the contract. If you signed at home or somewhere else outside the agent office, a statutory cooling-off period of fourteen calendar days applies on top of that, during which you can go back on your signature free of charge.
Work only with a BIV-recognised estate agent. That recognition means the agency falls under disciplinary law, holds professional liability insurance and has to abide by the code of conduct. When exclusivity works in your favour
Exclusivity is not a trap. For an agency it is the reason to free up budget. Professional photography, a floor plan, an EPC-ready bundle, paid visibility on the portals and possibly a video tour quickly cost several hundred euro. An agent who knows that a colleague cannot simply snatch the sale away will put those resources in.
You also have a single point of contact. All viewings, all offers and all feedback come in through the same person, which makes follow-up far simpler than when three agencies are showing the same candidate around.
There is another reason sellers often underestimate. When the same home is listed with several agencies, it sometimes appears on the portals with different photos, different surface areas and even different asking prices. Buyers notice that and read it as a file with no consistency. An exclusive mandate keeps your presentation tight, and that helps above all in the first weeks, when most serious viewers come by.
Where sellers get stuck
The biggest risk is simple: you are tied for six months to an agency that does not deliver. If the viewings fail to materialise, you cannot simply switch. Most agreements set a cancellation fee of up to fifty percent of the agreed commission. So read that clause before you sign, because the percentage and the conditions differ considerably from agency to agency.
A second stumbling block is the tacit renewal. If the first period runs out while you are busy with other things, the mandate rolls on unnoticed. Put the end date in your diary with a reminder two weeks in advance.
Finally, you lose your benchmark. Anyone working with a single agency hears a single asking price and a single fee percentage, without knowing whether that is in line with the market. Exclusive or open: how to weigh it up
A workable rule of thumb: choose exclusivity when you have found an agency you trust, and choose an open mandate when you do not have that trust yet. The form of the contract follows from your choice of agent, not the other way round.
Before you sign, always ask for three things. First, the term and the exact cancellation conditions. Second, the full fee including VAT, plus what happens to the costs incurred if the home does not sell. Third, a concrete marketing plan: which photos, which portals, what budget and when the first review follows.
Feel free to negotiate on the duration. Three months of exclusivity with an extension by mutual agreement is a reasonable starting point for both parties, and it keeps the pressure on. Have it included as well that you get an interim review after four to six weeks, with the number of viewings and the feedback from candidates.
